How to coordinate the development and security of generative artificial intelligence has attracted attention from all parties.

Recently, seven departments including the National Cyberspace Administration jointly announced the "Interim Measures for the Management of Generative Artificial Intelligence Services" (hereinafter referred to as the "Measures"), which will come into effect on August 15, 2023.

The relevant person in charge of the Cyberspace Administration of China said that the Measures were issued to promote the healthy development and standardized application of generative AI, safeguard national security and social public interests, and protect the legitimate rights and interests of citizens, legal persons and other organizations.

The "Measures" propose that the state adhere to the principle of balancing development and security, promoting innovation and combining governance in accordance with the law, taking effective measures to encourage the innovative development of generative artificial intelligence, and implementing inclusive, prudent, classified, and graded supervision of generative artificial intelligence services.

The Measures point out that innovative applications of generative artificial intelligence technology are encouraged in various industries and fields, generating high-quality content that is positive, healthy, and uplifting, exploring and optimizing application scenarios, and building an application ecosystem.

The Measures stipulate that industry organizations should be supported to collaborate in areas such as generative artificial intelligence technology innovation, data resource construction, transformation and application, and risk prevention.

The Measures stipulate that the provision and use of generative AI services should respect intellectual property rights, business ethics, keep business secrets, and not use algorithms, data, platforms and other advantages to implement monopolistic and Unfair competition behaviors.

The Measures emphasize that providers shall not collect unnecessary personal information, shall not illegally retain input information and usage records that can identify the user's identity, and shall not illegally provide input information and usage records of the user to others.

The Measures stipulate that those who provide generative artificial intelligence services with public opinion attributes or social mobilization capabilities shall conduct security assessments in accordance with relevant national regulations, and complete algorithm registration, change, and cancellation registration procedures in accordance with the "Regulations on the Management of Internet Information Service Algorithm Recommendation".

The Measures stipulate that providers should establish and improve complaint and reporting mechanisms, set up convenient complaint and reporting entrances, publicize the processing process and feedback time limit, promptly accept and handle public complaints and reports, and provide feedback on the processing results.
